Opposition Against Similar Trademark Applications

Trademark applications are published in the Official Trademark Bulletin if they are found eligible following examination by the Turkish Patent and Trademark Office. Published trademark applications may be opposed by relevant parties within the statutory opposition period.

Opposition against a trademark application is an important legal mechanism for protecting earlier trademark rights, trade names, rights acquired through unregistered use, well-known trademark status and other industrial property rights. In particular, registration of identical or similar signs for identical or similar goods and services may create a likelihood of confusion in the market and may harm the commercial reputation of the trademark owner.

In order to file an opposition, the relevant trademark application must be monitored during its publication period. If the opposition deadline is missed, the trademark application may proceed to registration, and more costly legal procedures may become necessary afterwards.

For this reason, trademark owners should regularly monitor new trademark applications that are identical or similar to their existing trademarks. Through trademark monitoring services, potentially conflicting trademark applications can be detected at an early stage and, where necessary, opposed within the statutory period.

A timely opposition enables the trademark owner to protect its rights in a more effective, faster and cost-efficient manner.

At Patentpark Consultancy, we evaluate published trademark applications not only from the perspective of visual similarity, but also in terms of trademark law, market realities, consumer perception, class similarity, earlier rights and evidence of use. Our objective is to protect our clients’ existing trademark rights effectively and to conduct opposition proceedings against risky third-party trademark applications at the right time and with strong legal arguments.

Opposition against a trademark application is an important legal tool for protecting existing trademark rights and preventing new applications that may create a likelihood of confusion in the market. An effective opposition process is not limited to merely claiming similarity; the application, earlier rights, class scope, evidence of use and sector dynamics must be assessed together.

Patentpark Consultancy provides its clients with strategic, detailed and result-oriented support in opposition proceedings against trademark applications, contributing to the strong protection of trademark rights.

Notice of Oppositions Filed Against Your Trademark Application

Trademark applications are published in the Official Trademark Bulletin if they are found eligible following examination by the Turkish Patent and Trademark Office. During the publication period, third parties may oppose the application on the grounds that it creates a likelihood of confusion with their earlier trademark rights, was filed in bad faith, takes unfair advantage of a well-known trademark or falls within other relative grounds for refusal.

The filing of an opposition against a trademark application does not mean that the application will automatically be rejected. At this stage, the applicant may submit a defense against the grounds of opposition in line with legal and commercial realities. A well-prepared counterstatement is critical for enabling the application to continue towards registration.

At Patentpark Consultancy, we approach defense proceedings against trademark oppositions not as a standard response petition, but as a strategic process in which trademark similarity, scope of goods and services, sector realities, consumer perception, prior trademark use and legal risks are evaluated together.

In defense proceedings against trademark oppositions, we conduct a detailed file-specific analysis. Each opposition is examined separately in terms of the applied-for trademark, the opponent’s earlier rights, class coverage, trademark similarity, use status and sector dynamics.

Within the scope of our services, we provide professional support in the following areas:

  • examination of the opposition petition and the trademarks relied upon,
  • comparison of the applied-for trademark with earlier trademarks,
  • similarity analysis of goods and services,
  • assessment of whether a proof of use request is required,
  • development of legal arguments against likelihood of confusion and other opposition grounds,
  • preparation of the counterstatement,
  • monitoring of the process before the Turkish Patent and Trademark Office,
  • development of a strategy for the appeal and re-examination stage after the decision.

Our objective is to ensure that your trademark application is defended in the strongest possible manner during the opposition process and to establish the right legal strategy to increase the likelihood of registration.

Appeals Against Office Decisions

Trademark applications may be accepted following examination by the Turkish Patent and Trademark Office; however, in some cases, they may be refused wholly or partially. Likewise, as a result of the examination of oppositions filed against a trademark application, a total refusal or partial refusal decision may be issued for certain classes or goods and services.

Refusal of an application does not necessarily mean that the trademark process has ended. Regardless of the reason, refusal or partial refusal decisions issued by the Office may be appealed within the statutory period, and re-examination of the decision may be requested.

Refusal decisions in trademark applications may generally be based on grounds such as lack of distinctiveness, descriptiveness, similarity with earlier registered or applied-for trademarks, or unsuitability for registration in relation to certain goods and services. In partial refusal decisions, the application is not refused in its entirety; rather, only certain goods or services are found unsuitable for registration.

At Patentpark Consultancy, we examine refusal and partial refusal decisions issued by the Office on a file-specific basis. We evaluate the reasoning of the decision, the structure of the applied-for trademark, earlier trademark records, class coverage and available legal appeal options together, and prepare strategic appeal files.

Filing an appeal against refusal or partial refusal decisions is important in order to:

  • ensure that the trademark application is re-examined,
  • demonstrate the registrability of the application through legal reasoning,
  • enable the application to proceed to registration with the broadest possible scope.

In this process, the appeal petition should not consist of general explanations only. It must be structured in a concrete and legally grounded manner, directly addressing the reasoning set out in the Office decision.

How Does the Appeal Process Work?

An appeal against refusal or partial refusal decisions issued by the Turkish Patent and Trademark Office must be filed within the period prescribed by the legislation. If no appeal is submitted within this period, the decision may become final and the application may not proceed in respect of the refused scope.

In the appeal process, the reasoning of the Office decision is first examined in detail. Earlier trademarks cited as the basis for refusal, the scope of goods and services, similarity assessment or absolute grounds for refusal are analyzed. Subsequently, the legal and technical arguments that may be raised in favor of the applicant are determined.

When preparing the appeal petition, the aspects of the decision that require re-examination are presented clearly and systematically. Where necessary, precedents, earlier registration examples, sectoral use information, commercial realities and evidence may be used to support the appeal grounds.

At Patentpark Consultancy, in partial refusal decisions, we consider not only the legal possibility of appeal, but also the commercial value of the application and the long-term trademark portfolio strategy. Patentpark Consultancy contributes to the effective protection of trademarks by providing strategic, comprehensive and file-specific appeal services against refusal and partial refusal decisions in trademark applications.

Warning Letters and Settlement in Trademark Infringement Matters

If third parties use a trademark without authorization, operate in the market with similar signs, imitate the trademark, or engage in infringing use on the internet or e-commerce platforms, the trademark owner has the right to pursue legal remedies.

Trademark infringement may arise when a sign identical or similar to a registered trademark is used without the trademark owner’s consent for identical or similar goods and services. If such use creates a likelihood of confusion among consumers, takes unfair advantage of the trademark owner’s commercial reputation or damages the distinctive character of the trademark, a claim of trademark infringement may arise.

Trademark infringement is not limited to the use of an identical trademark directly on products. Similar trademark use, packaging and label use, domain name use, social media account use, e-commerce store use, advertising texts, catalogues, signboards, fair materials or commercial documents may also constitute infringement depending on the circumstances of the case.

In trademark infringement matters, before initiating litigation or formal proceedings, sending a warning letter to the counterparty and seeking settlement may often be a strategic option. An effectively prepared warning letter clearly sets out the trademark owner’s rights, requests cessation of the infringement and serves as an official notice to the counterparty before possible legal proceedings.

At Patentpark Consultancy, we evaluate trademark infringement claims on a file-specific basis. We analyze the registration scope of the trademark, the allegedly infringing use, the commercial activities of the parties, the available evidence and potential legal risks together, and provide professional support in the preparation of warning letters and settlement negotiations.
