FTO – Freedom to Operate

FTO – Freedom to Operate

Freedom to Operate (FTO) Analysis

Freedom to Operate (FTO) analysis is a systematic legal and technical assessment conducted to determine whether a product, method, technology or commercial activity can be produced, used, sold, imported or launched in a specific market without infringing third-party patent rights.

FTO analysis is particularly important before market entry, product launch, investment decisions, technology transfer, licensing negotiations or large-scale production planning.

At Patentpark Consultancy, we conduct Freedom to Operate analyses by reviewing relevant patent rights in target countries and evaluating whether the product or technology under consideration may fall within the scope of enforceable third-party patents.

Why Is FTO Analysis Important?

A product may be technically innovative and even patentable, but this does not automatically mean that it can be freely manufactured or commercialized without risk.

Patentability and freedom to operate are different concepts. Patentability focuses on whether an invention is new and inventive over the prior art. FTO analysis, on the other hand, focuses on whether commercial use of a product or technology may infringe valid third-party patent rights in a specific jurisdiction.

Through FTO analysis:

  • potential third-party patent risks can be identified before market entry,
  • product launch and investment decisions can be made on a safer legal basis,
  • design-around strategies can be developed where necessary,
  • licensing or settlement options can be evaluated in advance,
  • costly disputes and infringement claims may be prevented,
  • commercial activities can be planned with greater legal certainty.

Scope of FTO Analysis

Within the scope of a Freedom to Operate analysis, the product, method or technology to be commercialized is first technically defined. Then, relevant patent documents are searched and reviewed in relation to the target country or countries.

The analysis may include:

  • identification of relevant enforceable patents,
  • review of patent claims,
  • comparison of the product or technology with the claim scope,
  • assessment of potential infringement risks,
  • evaluation of patent status, expiry, validity and territorial scope,
  • identification of possible design-around options,
  • strategic recommendations for market entry, licensing or further legal assessment.

FTO Is Not a Patentability Search

It should be emphasized that FTO analysis is not the same as a patentability search.

A patentability search evaluates whether an invention may be eligible for patent protection by comparing it with the prior art. FTO analysis evaluates whether a product or technology can be commercially used without infringing third-party patent rights.

Therefore, even if an invention appears patentable, an FTO analysis may still be necessary before production or market launch.

Patentpark Consultancy’s Approach

At Patentpark Consultancy, we approach FTO analysis not merely as a patent database search, but as a strategic risk assessment process directly connected to commercialization, production and market entry decisions.

We evaluate the technical structure of the product, the relevant patent claims, the target markets and the potential legal risks together. Our objective is to provide our clients with a clear, practical and commercially useful assessment before they proceed with production, launch or investment.
