Patent Legal Services

At Patentpark Consultancy, we provide comprehensive legal support in relation to industrial property rights through our specialized solution partners.

From registration procedures to litigation support, from oppositions to invalidation actions, we assist our clients at every stage of intellectual property law with an experienced and solution-oriented approach.

Oppositions and Defenses in Registration Proceedings

Registration procedures before the Turkish Patent and Trademark Office and other national or international intellectual property offices generally involve preliminary examination, search, formal review, legal assessment and, where applicable, opposition stages.

Opposition procedures are legal mechanisms designed to ensure that registration processes are assessed properly and that rights are protected in line with the principle of rightful ownership.

Appeals may be filed against partial or total refusal decisions issued by patent or trademark offices. In addition, where similar trademarks, designs or patents are published in official bulletins, opposition proceedings may be initiated to prevent the registration of such applications.

Defense procedures, on the other hand, are carried out against oppositions filed by third parties. These procedures aim to obtain rejection of the opposition through legally reasoned, evidence-based and file-specific arguments.

Warning Letters

Warning letter procedures are formal legal actions taken against individuals or entities that infringe intellectual and industrial property rights.

Following the identification of an infringement, a warning letter may be sent through a notary public in order to request cessation of the infringing act. Responses to warning letters received from third parties and the management of related defense processes are also handled within this scope through our expert legal partners.

Declaratory Actions

Declaratory actions are lawsuits filed to determine the existence or non-existence of a legal relationship through judicial proceedings.

In order to file such an action, there must be not only a legal relationship, but also a legal interest in obtaining a judicial determination. If the claimant’s right or legal position is under a current and concrete threat, and if a declaratory judgment is capable of eliminating that threat, the legal interest requirement may be deemed satisfied.

Performance actions may also be considered where there is no sufficient legal interest in filing a declaratory action.

Declaratory and performance actions may cover matters such as:

  • determination of evidence,
  • determination of infringement,
  • determination of non-infringement,
  • disputes concerning the existence or non-existence of an act or legal situation.

Seizure of Infringing Goods and Infringement Actions

Seizure of infringing goods and infringement actions may be initiated where an infringement has occurred and where it is necessary to prevent unfair commercial gain and stop the infringing activity.

These actions may be pursued when a party uses a trademark, design or patent belonging to another rights holder without authorization and without having its own valid industrial property right.

Within this process, it may be requested that infringing products be withdrawn from the market, production be stopped, and products be removed from sale. Where necessary, criminal proceedings may also be initiated through a criminal complaint filed with the Public Prosecutor’s Office.

Civil and Criminal Proceedings

Civil and criminal proceedings are legal actions initiated for the judicial resolution of disputes concerning intellectual and industrial property rights.

Due to the specialized nature of these disputes, such cases are generally heard before specialized Intellectual and Industrial Property Rights Courts. In places where such specialized courts are not available, cases may be pursued before competent general courts having the same jurisdiction.

Invalidation Actions

Invalidation actions are lawsuits filed for the legal cancellation of registered trademarks, designs or patents.

Such actions may be initiated to challenge final registration decisions or to invalidate registrations obtained unfairly or in bad faith by third parties.

If an invalidation decision becomes final, the registration is deemed to have been legally removed with retroactive effect as of the application date.
